有在读PhD学生尝试过问学校申请non cap H-1B嘛？

接上一个帖子：EB1-A, NIW与renew F1的困扰
这两天一直在研究身份方面的问题，发现H-1B是可以有移民倾向的，再想了一下学校正好是办non cap H-1B的大户，所以脑洞大开，好奇PhD学生能不能向学校申请这种H-1B呢？这样回国的话就是签H-1B签证，不用担心140提交后的问题了。

Non-cap H1b也有工资要求吧 phd学生估计达不到吧

搜了一下 An H-1B nonimmigrant working part-time, whose actual annual compensation is less than $60,000, would not qualify as exempt on the basis of wages, even if the worker’s earnings, if projected to a full-time work schedule, would theoretically exceed $60,000 in a year.
本来还以为50%的工资可以投射成按100%来满足这个要求，但看起来是不行的。
不过有些工资高的学校算了下是可以满足这个要求的。

诶不对看了下，有硕士学位的也可以
An exempt H-1B nonimmigrant is an H-1B worker who meets one of the following statutory standards:

  • Receives $60,000 annual wages; or
  • Has attained a master’s or higher degree (or its equivalent) in a specialty related to the intended H-1B employment.”

我感觉理论上也不是不行的？你是正儿八经有这样一份TA/RA的工作的。

用你的时候当工人压榨，给福利的时候告诉你只是个学生

我们州把我们定性成州雇员，因此不能集体议价，所以我们的学生工会是违法的 :liekai:

问题是 TA/RA 这些 appointment 都会随时变动，不可能及时做 h1b amendment
更何况，这些都要钱，advisor/school 不太可能愿意付这些额外的钱和行政工作
