Yes. Here’s why…
There are two reasons why downloading or streaming files using BitTorrent can get you in trouble, and why you need to use a VPN to protect yourself when doing it:
- BitTorrent is very public. BitTorrent is very efficient at distributing large files to large numbers of people. The more people trying to download a file, the more efficient it is. And everyone connected to that particular cloud can see the IP addresses of everyone else in it. It’s pretty common for anti-piracy agencies to have people joining a BitTorrent cloud for a bit of media that one of their clients holds the copyright for, in order to record the IP addresses of everyone downloading their client’s work. They then use those IP addresses to identify who those people are, and start sending nasty letters to their ISPs. Or else use that data in suing the torrent site those people used to get the torrent. Using a VPN conceals your actual IP address so no one can connect that activity back to you. All anyone sees is the IP address of the VPN’s gateway server that you’re connected to.
- If you’re using BitTorrent, you are distributing content to others. This is actually the big one. Copyright law focuses on distribution, not consumption. BitTorrent is so efficient because as soon as even one peer in a cloud has a piece of the file they’re trying to download, they start sharing that piece with everyone else who’s trying to download the file. And this is the key: it’s not the downloading that’s illegal, but the uploading. It’s not a crime for you to watch a copyrighted movie that someone else uploaded to YouTube. The person who uploaded it committed illegal copyright infringement by uploading the movie without the express consent of the copyright holder, but you’re not doing anything illegal by watching it. (YouTube gets a pass due to certain exemptions in the law for service providers, as long as they play nice with authorities.) The same is true if you download a movie from a filelocker service like RapidGator. But because of the way the BitTorrent protocol works, if you download a file, you’re also uploading it. It doesn’t matter what software you’re using or what change you make in the settings, if you use BitTorrent to download copyrighted media, you’re sharing it with others and committing illegal copyright infringement.
Using a debrid service eliminates both of these issues.
First, the only two parties involved are you and the debrid service. You’re downloading content from the debrid service’s servers. (Or streaming it, which is just watching something as you download it. On a technical and legal level there’s no difference.) Third-party anti-piracy agencies would have to monitor everything everyone does on the internet to see this, and even if they did they wouldn’t be able to tell what files you’re downloading since the connection is encrypted. Even your ISP can only see that you’re connecting to the debrid service, but not what data you’re downloading.
Second, and most importantly, you’re not committing a crime when using a debrid service. (At least according to US copyright law, but copyright law is fairly similar in other countries thanks to international agreements like the Berne Convention.) Just like with the example of watching something that someone else uploaded to YouTube, you’re not the one distributing the content, so you’re not committing copyright infringement. The debrid service has more to be concerned about third parties monitoring your activity than you do.
So if you’re downloading copyrighted media using BitTorrent, you are breaking the law. You are a pirate. You’re committing piracy. Arr. But if you’re using a debrid service to download copyrighted media, you’re merely observing the law being broken. You are greeting the ships when they come to port, and happily unloading the booty, but you are merely pirate-adjacent. Yo ho.
