opt期间有主要工作的话，这种兼职需要给公司报备么，应该肯定是要给sevp报备的？。。法盲之前看到过好几次类似的工作一直没敢搞
如果被调就得考虑
我记得公司好像不允许兼职（利益冲突的大帽子）不能丢西瓜捡芝麻
如果只是ssn为了报税那问题不大

之前handshake也是给ai做label的招人就写的opt可以，stem opt不行，

我觉得是的，但公司的合同肯定是大帽子大口袋，你觉得干点什么都可能违规
确实不被发现就行。所以我就想只是提供ssn，不提供公司信息就也还好。大不了我给LD申请一下我去干活就完事了。

问了问GPT，貌似只有STEM extension不行。 regular post- completion OPT是可以的. 而且OPT要求Major related，干这种trainer属于纯天然满足的。
非律师建议，仅供参考。
If it is truly 1099 independent-contractor work, then the usual rule of thumb is:
Regular post-completion OPT: often can work.
STEM OPT extension: generally cannot, unless it is restructured into a real employer-employee setup.
Why:
For regular OPT, DHS/SEVP guidance has long allowed flexible work arrangements, including self-employment, as long as the job is directly related to your degree and you properly document it.
For STEM OPT, USCIS says the employer must maintain a bona fide employer-employee relationship with the student, and the STEM employer must support the training plan requirements. That is usually inconsistent with a plain 1099 contractor arrangement.
So in plain English:
- If you are on initial OPT, a 1099 job is often acceptable if it is related to your major and you keep good records.
- If you are on STEM OPT , a 1099 job is usually not safe/compliant .
The safest practical move is to ask your DSO/international office one sentence:
“I have a 1099 independent-contractor offer related to my degree. Does my current OPT status allow this, and if not, would it need to be W-2?”
