养鸡场的perm能续H1B吗

现在的公司perm已经fail了好几次了，H1B也没剩下几年了，担心到期后I140没下来续不了H1-B。想问下有了解养鸡场的吗？朋友说能办下I-140但不确定可不可以用这个I-140续H1-B。 我自己查了一下貌似H1-B续的时候没有对I-140的职业有特别要求，只要是approved I-140就行。但是也看到有人说问过律师说职业不匹配续不了？

是可以的，但风险比较高，稳妥的办法建议谷歌搜索AC21 1 year pending

This ability comes from the American Competitiveness in the 21st Century Act (AC21):

  • §106(a) & (b) — allow 1-year extensions if PERM/I-140 pending ≥ 365 days.
  • §104(c) — allows 3-year extensions if you have an approved I-140 and can’t file adjustment of status yet due to visa backlog.

Nowhere in AC21 does it require the same occupation or same employer.
